Online classes release and waiver

By participating in the online classes provided by Indi Pole Pty Ltd, I acknowledge and agree that:

1. By signing up for a class, I will participate in various pole, chair, floor, stretching, dance, and fitness exercises, either in a private class or group held online or as a pre-recorded video. 
2. It is my responsibility to consult with a physician before and regarding my class participation. 
3. I confirm I am in good physical condition and do not suffer from any known health condition that would prevent or limit my participation in this exercise program or that would be detrimental to my health if I participated in this activity.
4. I access and participate in online classes provided by Indi Pole Pty Ltd entirely at my own risk. 
5. Participation in these activities may lead to injury, illness or death. I acknowledge that I should seek the advice of a doctor or other qualified health or fitness provider before starting any fitness regime or with any questions I may have regarding a fitness regimen or medical condition. I expressly agree that Indi Pole Pty Ltd will have no liability for property damage, bodily injury, or death and that I voluntarily assume all known and unknown risks associated with the use of the online classes.
6. I agree that Indi Pole Ltd and their instructors are not medical professionals and do not provide any medical diagnoses or treatments. I agree that if I have any medical condition, I will seek the help of a medical professional.
7. I absolutely and unconditionally release and waive Indi Pole Pty Ltd and all associated instructors, employees, contractors and associates from any and all claims, demands, or causes of action of any kind, nature, or description.
8. Indi Pole Pty Ltd shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for lost profits, use, goodwill, data loss or other intangible losses, cost of procurement of substitute goods or services, or special, direct, indirect, incidental, punitive, or consequential damages of any kind resulting from participation. 
9. I hereby affirm that I have attained the legal age of majority and have carefully considered the terms of this agreement. By entering into this agreement, I acknowledge that I am voluntarily relinquishing certain legal rights and/or remedies that may be available to me or to the participant. If I am executing this agreement as a parent or legal guardian of a minor child, I certify that I am duly authorized to do so and that I waive and release Client Parties from any and all liability, claims, costs, and damages of any kind which may arise from the participation of the minor child in Classes.

Whom this Affects; Binding Effect

1. This Agreement will be legally binding not only on me but also my heirs, next of kin, and legal representatives, and will run in favor of, and may be enforced by, each of the released parties. It will be binding to the fullest extent permitted by law. If any provision of this Agreement is found to be illegal, invalid, or unenforceable, the remaining terms will be effective. This Agreement will be governed by Australian law.

Terms of Service

1. Class Recordings
   
   
   1. Indi Pole Pty Ltd conducts its live Classes through Zoom. I understand that if I ask a question or make a comment, I and my surroundings may appear onscreen, and my voice will be heard by participants in the session. I also understand that Indi Pole Pty Ltd may record live Classes and make the recordings (“Recordings”) available to other participants, and that Indi Pole Pty Ltd will not edit my image or voice out of any Recording.
   2. As such, I consent to my image, statements, voice, and surroundings being included in Recordings, and to such use of Recordings by Indi Pole Pty Ltd. I understand that I will not have the opportunity to review or approve any Recordings and that I will not receive any payment for their use. 
   3. I understand that Indi Pole Pty Ltd will own the copyright and all other rights in the Recordings. I waive any legal claims relating to the Recordings, including those relating to copyright, rights of publicity or privacy, or defamation, or arising from any distortion, blurring, or alteration that may occur in the making, editing, or use of the Recordings.
2. Online Instruction Methods
   
   1. I acknowledge that class and workshop instruction methodologies and videos are the property of Indi Pole Pty Ltd. I will not record, reproduce, distribute, sell, or otherwise copy or transfer any such Classes without first obtaining the express written consent of Indi Pole Pty Ltd.
   2. Indi Pole Pty Ltd and its employees or agents have the right to take photographs, videotape, or digital recordings of me and to use these in any and all media, now or hereafter known, exclusively to promote Indi Pole Pty Ltd’s services.
   3. All of the choreography and instructional techniques provided in these classes have been created for Indi Pole Pty Ltd by the owner/creator and are protected under copyright/trademark laws. No classes may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without Indi Pole Pty Ltd’s written permission.
   4. I understand that my registration for a Class does not entitle other members of my household, friends, or other individuals (collectively, “Third Parties”) to participate in the session. I will be responsible for any Third Parties who do participate. 

Cancellations & Refunds

1. You must cancel your class directly through your account more than 12 hours before your class starts time. All amounts paid for that class will be forfeited if you do not.
2. NO REFUNDS provided on any class passes or memberships. On rare occasions, and for any reason, we may provide a refund, discount, or other consideration to some or all of our subscribers (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
3. To cancel your class or subscription, please log in to your account HERE & select the item you’d like to cancel.

Subscriptions & Billing

1. Monthly Membership entitles you to unlimited classes on “Indi Studio” – our online class platform, including 4-week series’, online workshops & all regular classes. This does not include our Mentorship or Masterclasses, which are sold separately.
2. Certain products and services (“Products”, “Paid Services”) are made available to the User by Indi Pole Pty Ltd through the Website. By purchasing any Paid Services, you signify that you have read, understand and agree to be bound by this Agreement in effect at the time of purchase. We attempt to describe the Products offered on the Website as accurately as possible; however, we do not warrant that the descriptions or other content on the Website are accurate, complete, reliable, current or error-free.
3. To access Paid Services, you will be required to provide a credit card or other payment method accepted by Indi Pole Pty Ltd., as may be updated from time to time (“Payment Method”). As used in this Agreement, “billing” shall indicate either a charge or debit, as applicable, against your Payment Method. By submitting an order through the Website, you authorize Indi Pole Pty Ltd., or its designated payment processor, to charge the account you specify for the purchase amount. Billing to your Payment Method occurs at the time of purchase or shortly thereafter. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or related charges. Check with your bank and credit card issuers for details. You are solely responsible for any and all fees charged to your Payment Method. If you want to use a different Payment Method or if there is a change in Payment Method, such as your credit card validity or expiration date, you may edit your Payment Method information by going to your account settings on the Website.
4. The content available through the Services, including but not limited to videos, designs, text, graphics, pictures, music, information, data, software, logos, and code (collectively, the “Site Material”), is the proprietary property of Indi Pole Pty Ltd. and its licensors, and is protected by intellectual property laws. No Site Material may be modified, copied, distributed, framed, mirrored, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without Indi Pole’s prior written permission. However, you are permitted to post your own User Content, as defined in the section below, on the Website.
5. Membership Plans, Commitment & Auto-Renewal
   Indi Pole Pty Ltd offers weekly, monthly, and yearly membership options, each providing access to unlimited online classes, including live classes and the video library (excluding separately sold products such as mentorships and masterclasses). By subscribing to any membership, you agree to the applicable minimum commitment period and automatic renewal terms. The SLINK IN, Weekly Membership requires a minimum commitment of four (4) consecutive weeks (1 month) and renews automatically on a weekly basis unless cancelled after the minimum term. The STAY SLINKY, Monthly Membership requires a minimum commitment of three (3) months and renews automatically on a monthly basis unless cancelled after the initial commitment period. The SLINK SOCIETY, Yearly Membership renews automatically on a yearly basis.
   1. All memberships will continue to auto-renew at the applicable billing cycle unless cancelled prior to the next billing date via your account settings. By purchasing a membership, you authorize Indi Pole Pty Ltd (or its payment provider) to charge your selected payment method on a recurring basis in line with your chosen plan.
   2. Failure to cancel before the renewal date will result in the next billing cycle being charged in full.

Suspend or terminate the user’s access to the platform;
Pursue legal remedies, including reimbursement of losses and enforcement of contractual obligations.
